Terms of Service

1. Acceptance

By installing or using Muster (the “Service”) in your Discord server, or by accessing the Muster web application, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Muster is a participation-tracking bot and companion web application for Discord communities. The Service records voluntary participation (voice attendance, reaction check-ins, quest completion, staff-issued awards) and exposes those records through a leaderboard, currency wallets, and a public API for use by guild administrators and their members.

3. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction to use Discord) to use the Service. Server administrators are responsible for ensuring members of their server meet this requirement.

4. Acceptable use

You agree not to:

Use the Service to harass, defraud, or harm other users;
Attempt to circumvent rate limits, authentication, or authorization mechanisms;
Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service except to the extent permitted by applicable law;
Use the Service to violate any applicable law or the terms of Discord's own policies;
Resell, sublicense, or commercially redistribute the Service without prior written permission.

5. Discord

The Service interacts with Discord through Discord's official APIs. Your use of Discord remains subject to Discord's Terms of Service and Privacy Policy. The operators of Muster are not affiliated with Discord Inc.

6. Privacy

Our handling of personal data is described in our Privacy Policy. By using the Service you also consent to the practices described there.

7. Server administrator responsibilities

If you install the Service in a Discord server, you are the “server administrator” for that server's data. You are responsible for:

Informing your members that participation tracking is enabled;
Configuring role mappings and privacy defaults appropriate to your community;
Honouring member opt-out requests through the controls Muster provides;
Responding to data deletion or export requests from your members.

8. Availability and changes

The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features at any time without notice. We do not guarantee uninterrupted availability, and we are not liable for downtime, data loss, or interruptions.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATORS OF MUSTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (i) the amount you paid us in the twelve months preceding the claim or (ii) one hundred US dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless the operators of Muster from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if we believe you have violated these Terms. You may stop using the Service at any time by removing the bot from your server. On termination, we may delete data we hold about you, subject to legal retention obligations.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top of this page. Continued use of the Service after a change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of [jurisdiction to be finalized], without regard to conflict-of-law principles. Any dispute will be resolved in the courts of [venue to be finalized].
